Mr. Garrett has been a shareholder since 1989. He is an active trial lawyer focusing on general insurance defense and products liability. He has successfully defended retail stores in premises liability cases; pharmacists accused of negligence in the filling of prescriptions; and manufacturers in products liability related claims. He has litigated hundreds of cases throughout the State of Alabama, and he had a significant role in creating new law in Estate of Jewel Deal v. Rite Aid of Alabama. Mr. Garrett represented Rite Aid in this case, which established that an allegation of pharmacy negligence in the mis-filling of prescriptions falls under the Alabama Medical Liability Act and is not to be judged as an ordinary negligence claim in the traditional sense. This victory served to preclude plaintiff's attorneys from proving other incidents of mis-filled prescriptions unrelated to the specific case at hand, and it created a greater burden of proof for plaintiffs suing pharmacists for negligence than in an ordinary negligence case. Prior to joining the firm, Mr. Garrett began his trial career as a state prosecutor in Tampa and Plant City, Florida. As State Prosecutor, he handled a number of important felony prosecutions in jury trial. RECENT PRACTICE HIGHLIGHTS Assisted attorneys for Ford Motor Co. in a crash-worthiness case, alleging defect resulting in death of occupant of a vehicle in a roll-over accident. Successfully closed several pharmacy negligence cases alleging that pharmacists mis-filled prescriptions resulting in serious injury and death.
