Practice Areas Litigation, Electronic Discovery Biography Julia W. Mann is a partner in the Litigation section of Jackson Walker. She represents a wide range of clients in civil litigation, arbitration and appeals. Her primary focus is on commercial litigation matters, including contractual disputes, professional liability claims, shareholder disputes, business torts such as fraud, negligent misrepresentation, breach of fiduciary duty, tortious interference, and creditors' rights. Ms. Mann's practice involves handling cases in federal and state trial courts, the Texas Court of Appeals, Texas Supreme Court, and the Fifth Circuit Court of Appeals, as well as alternative dispute resolution forums such as AAA and NASD arbitrations and mediations. Oil and Gas Litigation Ms. Mann has represented mineral interest owners, operators, and service providers in litigation matters throughout South Texas. Such matters have included royalty disputes, asset purchase agreements, joint operating agreements, and the duties owed by and between operators and joint venturers. Representation of owner-operators and mineral subcontractors has included filing and defending against mineral contactors' liens. Environmental Cases Ms. Mann's environmental experience includes private-party enforcement actions, professional negligence, personal injury, and property damages claims. Creditor Representation Ms. Mann has represented both companies and individuals in a wide variety of matters related to breach of contract and debt collection claims, including: collecting accounts, promissory notes and guarantees through default judgment, summary judgment and bench trials before both state court and bankruptcy court through adversary proceedings. Such representation has included defending fraudulent transfer, wrongful foreclosure, usury and liability claims. Employment Disputes Ms. Mann's experience includes defending employers in discrimination, wrongful discharge, retaliation and other related employment issues. In one notable case, Elias Diaz Vega v. Advance Auto Parts, Inc. et al., Ms. Mann obtained summary judgment for the employer in a case brought by a 30-year employee who claimed wrongful termination based on both national origin and age. Appeals Ms. Mann has represented clients in state and federal court appeals. She has handled mandamus proceedings involving arbitration, discovery and other pre-trial matters. She has handled appeals following the entry of judgment both from magistrate courts and the district courts as well as appeals reaching both the Texas Supreme Court and the United States Supreme Court. Representative Matters In Re SI Restructuring Inc., 542 F.3d 131 (5th Cir. 2008). In separate appeal related to equitable subordination claim, the Fifth Circuit reversed the bankruptcy court ruling allowing distribution of reserve funds and remanded for determination of amount of secured claim and providing for disgorgement of fees to pay such claim. Wooley v. Faulkner (In Re SI Restructuring Inc.), 532 F.3d 355 (5th Cir. 2008). Fifth Circuit reverses and renders judgment for Jackson Walker clients in $3.5 million bankruptcy dispute over equitable subordination claims. In Re Reliant Surgical, L.P., No. 06-8065-CV (Tex. App.San Antonio, 2006 pet. denied). Fourth Court denied petition for writ of mandamus of trial court order granting client's motion to compel arbitration. In Re Kenwood Communications, No. 04-02-00377-CV (Tex. App.San Antonio, 2003, pet. denied). Fourth Court reverses and enters order compelling arbitration in client's home state of California. Multi-million dollar business dispute involving alleged partnership to expand operations into Mexico. Grothues v. City of Helotes, 928 S.W.2d 725 (Tex. App.San Antonio 1996, no writ). Upholding summary judgment in favor of the city and its proper exercise of police power.
