Hal Neier practices in the areas of commercial, securities, employment, and estate litigation, and has played substantial roles in complex cases such as the Phar-Mor, Inc. securities litigation. Among other matters, Mr. Neier served as lead counsel on behalf of a large financial services firm in an action pending in Delaware Chancery Court involving a claim for breach of a $400 million credit agreement. He also represents a well-known internet/media company in a $20 million fee dispute with a major investment bank. Mr. Neier has recently represented an international manufacturing company in a federal litigation arising out of a failed $3.5 billion merger transaction, and a well-known financial institution in a trial in bankruptcy court concerning a leveraged lease. Mr. Neier also has represented clients in the motion picture and entertainment industries, including a major motion picture studio defending against copyright infringement claims, and the producer of a Broadway play in a breach of contract action brought by a well known stage and screen actor. Mr. Neier also has extensive experience in litigation involving the enforceability of non-competition agreements, and in disputes between competitors concerning employee recruitment practices. Mr. Neier is a member of the New York City Bar. In recognition of his service as pro bono counsel to a person under a sentence of death, Mr. Neier received the Thurgood Marshall Award from the New York City Bar. Mr. Neier graduated with honors in 1982 from Yale College and in 1986 from New York University School of Law, where he was elected to the Order of the Coif and received the John Norton Pomeroy Prize for academic excellence. He also received the Edmond Cahn Award for his outstanding contribution as an editor of the New York University Law Review. Prior to joining FKSA, Mr. Neier worked as a litigator at Paul, Weiss, Rifkind, Wharton & Garrison and as a law clerk to The Honorable Charles E. Stewart, Jr. of the U.S. District Court for the Southern District of New York.
