David Erb is a partner in the Philadelphia office, resident in Westminster, Maryland. He is a leading member of the Fisher & Phillip's employee defection and trade secrets practice group which has a national practice and member attorneys throughout the country. David concentrates on the issues of employee recruitment and defection of highly-compensated employees: covenants not to compete, non-solicitation, non-use and non-disclosure agreements, unfair competition, employee raiding, trade secrets and confidential business information, duty of loyalty, and the protection of business data under various federal and state statutes. David's cases typically involve prosecuting or defending against requests for temporary and preliminary injunctions, as well as damages actions. David's practice includes a particular focus on representing companies navigating the complex issues surrounding en masse defections, hiring multiple employees from a competitor, and employee movement precipitated by mergers and acquisitions. David has handled hundreds of employee recruitment/defection matters. He has represented clients ranging from significant financial services institutions, including broker-dealers, money managers, investment banks, commercial banks, insurance and re-insurance brokers and insurance companies, to mid-size and smaller companies in industries such medical, pharmaceutical, engineering and computer services, as well as community banks. David also has experience with class action lawsuits involving the effect of corporate mergers on employee minority shareholders.
